R Kelly ‘s desire to escape jail over coronavirus fears denied by judges

R Kelly ‘s desire to be let out of jail over fears of the coronavirus pandemic was denied by a judge.

The singer's legal team had filed a motion to dismiss him at the Chicago Metropolitan Correctional Center, where he is being held without bail, as he awaits trial for several sex crime charges he denies.

But today, his request was denied by the United States District Judge Hon Ann M Donnelly.

The legal team for R Kelly, 53, had claimed he was in the high-risk category of people most susceptible to COVID-19 because of his age and existing health problems.

The lawyers also alleged that hand sanitizer and soap were hard to come by in prison, most prisoners are kept in small cells with at least one other inmate, which makes it impossible to maintain social distance from one another.

But the judge didn't approve.

They wrote in their verdict: “Although I am sympathetic to the defendant is understandable, fear about COVID-19, he has not demonstrated that compelling reasons justify his release.

"There are currently no confirmed cases of COVID-19 at the MCC in Chicago."

She also said the prison had taken steps to protect inmates and staff, including suspending all legal and social visits, making soap available to inmates, and screening and testing all those who had access to the prison.

The judge also said that she felt R Kelly hadn't shown that he was in the high-risk category defined by the Centers for Disease Control and Prevention (CDC).

She added: "The defendant is fifty-three years old, twelve years younger than the group of" older adults "defined by the CDC as at high risk for serious illness from COVID-19.

“Although the defendant has had surgery during his imprisonment, he fails to explain how his surgical history puts him at a higher risk of serious illness.

"In addition, officials in Chicago advised the government that doctors have completed all treatment for the act performed by the defendant."

She also said that R Kelly is still able to contact his attorneys by phone and email during the crisis, and that in fact, you now have extra time to prepare for the exam than is unlikely it will expire as planned on July 7th.

The judge also said R Kelly is in custody because he is "at risk of escaping or trying to obstruct, threaten or intimidate possible witnesses".

She came to the conclusion: "Accordingly, the defendants motion for bail, the hearing and the order for the granting of temporary release is denied."

R Kelly, famous for his hit I Believe I Can Fly, was scheduled to face trial in New York in July and in Chicago in October.

He denies all allegations have been made against him.
